Note: If you do not fully accept the conditions below, you are requested NOT to participate in any on- or off-campus activity sponsored or supported by Sierra Nevada College.
By signing this Indemnification and Release Form, you are releasing SIERRA NEVADA COLLEGE, its officers and directors, faculty, staff, coaches, agents,employees, hosts of the events, and sponsors (hereafter collectively referred to as “SIERRA NEVADA COLLEGE”) from and against any and all liability, including liability for negligence, and you are acknowledging that SIERRA NEVADA COLLEGE is disclaiming all warranties. This release is applicable for all SNC related or sponsored, on-and-off campus, activities, events, academic or recreational programs, field trips, club sports, and special events.
Notice of Risk: I understand that participation in athletic activity is dangerous and may expose me to risk of serious bodily injury and possibly death. These risks include, but are not limited to, the possibility of collisions with other participants, spectators and the public, vehicle accidents while traveling to and from such activities, and equipment failure. I understand that no degree of care or caution can completely eliminate these risks.
Assumption of Risk, Release of Liability, Requirement to Maintain Insurance: I hereby freely and expresslyassume and accept any and all risk of injury and/or death arising from my participation in any and all athleticactivities I may undertake by or though SIERRA NEVADA COLLEGE, or while traveling to and from suchactivities, or from the use of any equipment provided or furnished to me by SIERRA NEVADA COLLEGE. I herebyrelease SIERRA NEVADA COLLEGE from liability for any and all injuries and damages, including death, arisingfrom my participation in any and all athletic activities I may undertake, including the use of any and all equipmentprovided or furnished to me. In so doing, I release SIERRA NEVADA COLLEGE from all liability, including, butnot limited to, liability for negligence, failure to warn, product liability and warranty arising out of or in any wayconnected with my participation in athletic activities. Furthermore, I promise and agree not to make any claim orcommence any lawsuit against SIERRA NEVADA COLLAGE for injuries or damages arising from my participationin such activities or from the use of such equipment. As to the use of any equipment provided or furnished to me bySIERRA NEVADA COLLEGE, I expressly disclaim any and all warranties connected with such equipment. I haveinspected and agree to accept such equipment “as is,” and agree that there are no warranties with respect to suchequipment which extend beyond the face of this agreement. I also acknowledge that I am required to carry andmaintain my own accident and health insurance sufficient to meet all costs and expenses which I might incur as aresult of any injury I might sustain while participating in athletic activities, and by initialing below I acknowledgethat I am presently covered by such health insurance.
Indemnity Agreement: I promise and agree that I will not allow any other person to use any equipment provide orfurnished to me by SIERRA NEVADA COLLEGE. I hereby agree to indemnify SIERRA NEVADA COLLEGE fordeath or injury to myself or any other person or property arising from my participation in athletic activity, and/or theuse of any such equipment provided or furnished to me. I further agree that in any action or proceeding arising out ofthis agreement, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs from the otherparty or parties, in addition to any other relief. If any provision of this agreement is held in whole or in part to beunenforceable for any reason, that provision will be severable and the remainder will remain enforceable and ineffect.
I have carefully read this agreement and fully understand its contents. I am aware that this is a release of importantlegal rights and a disclaimer of important warranties, that I am signing this agreement in consideration of myparticipation in athletic activities, and that this agreement is an enforceable contract between myself and SIERRANEVADA COLLEGE, which I sign freely and voluntarily.
